These Terms of Service ("Terms") govern your use of the Fetch mobile application and the website at fetchwx.com (collectively, the "Service"), operated by Fetch ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years of age to use Fetch. By using the Service, you represent that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
To access certain features, you must create an account using a valid email address and password. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or abusive purposes.
Fetch provides surf, sail, and weather forecast information sourced from publicly available data providers including Open-Meteo, NOAA, and other meteorological sources. The Service is designed for informational and recreational purposes.
Fetch does not guarantee the accuracy, completeness, or reliability of any forecast data. Weather, surf, and ocean conditions are inherently unpredictable. Forecast data is provided "as is" and should not be relied upon as the sole basis for decisions that could affect your safety or the safety of others.
Specifically:
Fetch offers optional premium subscriptions that provide access to additional features. Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.
Free trial periods, if offered, automatically convert to paid subscriptions at the end of the trial unless canceled. You will be clearly informed of the trial duration and subscription price before starting a trial.

The Fetch name, logo (wavemark), brand identity, app design, user interface, and original content are the intellectual property of Fetch. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.
Forecast data sourced from third-party providers (Open-Meteo, NOAA) is subject to those providers' respective terms and licensing. NOAA data is in the public domain.
Any content you provide through the Service (such as saved locations, preferences, and feedback) remains yours. By using the Service, you grant us a limited license to store and process this content solely for the purpose of providing the Service to you.
Your privacy matters to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.
We strive to keep Fetch available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.
To the fullest extent permitted by applicable law, Fetch and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, but is not limited to, damages for loss of profits, data, goodwill, or other intangible losses.
Our total liability to you for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.
You agree to indemnify and hold harmless Fetch and its owners, officers, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Walton County, Florida.
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. The "Last updated" date at the top reflects the most recent revision. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.
